Supreme Court suspends for 90 days the enforcement of NR-1 penalties related to psychosocial risks

The Brazilian Supreme Court (STF), in a preliminary injunction, suspended for 90 days the imposition of fines and other penalties related to the new requirements of Regulatory Standard No. 1 (NR-1), with regard to the inclusion of psychosocial risks in occupational risk management.

The changes introduced by MTE Ordinance No. 1,419/2024 now require employers to identify, assess, and manage psychosocial risk factors in the workplace. The preliminary injunction highlighted the need for greater clarity regarding the criteria for assessment and sanctions.

It is important to note that during the suspension period, the general guidelines of NR-1 remain valid and must continue to be observed by employers, but sanctions based on provisions related to psychosocial risks are suspended.

After the 90-day period, the Court will rule on the matter again.
