Ministry of Labor and Emplyment (MTE) once again extends the Instruction that changes rules for work on Sundays and holidays
The change, which requires collective bargaining for work in these situations, has been postponed for the fourth time and will now take effect in 2026
Through Instruction MTE No. 1,066/2025, published on June 17, the Ministry of Labor and Employment announced the extension of the effective date of the rules regarding work on Sundays and holidays. The measures will take effect on March 1, 2026. Until then, they were scheduled to come into force in July 2025.
This is the fourth time that Instruction No. 3,665/2023 has been postponed, in response to pressure from lawmakers and economic sectors.
According to the government, the requirement, which establishes that work on non-working days may only occur through a collective bargaining agreement between employers and unions, aims to correct a distortion introduced in 2021, when work on these days was allowed based solely on an individual agreement between the worker and the employer, in violation of Law No. 10,101/2000.
