Notice of non-occurrence of suspicious operation for companies registered with SUSEP

In December 2018, the current deadlines for reporting non-occurrence of a suspicious transaction (negative statement) by the sectors required by Law 9.613/1998, which provided for crimes of "laundering" or concealment of assets, rights and values as well as the use of the financial system for those illicit acts.

Among the entities required to provide the information, we highlight that insurance and capitalization companies, local and admitted reinsurers, and open entities of complementary welfare, all with registration in SUSEP, must make the communication of non-occurrence - CNO (negative declaration) to this institution until the 20th of the following month (§ 2 of article 15 of SUSEP Circular No. 445/2012).

Individuals or legal entities that carry out any of the activities listed in this law must notify COAF (Financial Activities Control Council) or the respective regulatory institution of the activities or operations that may constitute indications of crimes of laundering or concealment of assets, rights and values.

Negative communications to SUSEP must be made exclusively on the page http://www.susep.gov.br/menu/informacoes-ao-mercado/comunicacoes-negativas. Each entity is responsible for sending their statements and the accounts and passwords required for access are exclusive to each person obliged and can be requested by email to wmaster.rj@susep.gov.br.

We emphasize that entities that fail to report a non-occurrence of a suspicious transaction, in the defined format and term, are subject to administrative sanctions, which include warning, fine, temporary disqualification for individuals, and cancellation or suspension of business activity, according to art. 12 of Law 9,613/1998.
