Instruction MTE No. 1.131/2025: Increased fines and labor obligations for companies
Instruction MTE No. 1.131/2025 brought important updates for companies regarding applicable fines on labor and tax obligations, following the amendment of Article 81 of Ministerial Ordinance MTP No. 667/2021, which regulates the guidelines for organizing administrative processes related to the Government Severance Indemnity Fund For Employees (FGTS) and other social contribuitions.
One of the main changes refers to the increase in fines applied to employers who fail to provide correct information or meet the deadlines required by eSocial. If an employer omits or submits incorrect data about their employees, they will be subject to a minimum fine of BRL 443.97, plus BRL 104.31 for each affected worker. The maximum fine can reach BRL 44,396.84, which may be doubled in cases of recurrence, resistance to inspection, or disrespect towards authorities.

Additionally, the Instrucation establishes a 40% discount on the fine for infractions that occurred between January 1, 2020, and the date of publication of the new regulation, provided they are regularized within the specified terms.
