Maternity leave period extended in case of hospitalization
Law No. 15,222/2025, enacted by the Federal Government on September 29, amended the Consolidation of Labor Laws (CLT) and Law No. 8,213/1991, also known as the Social Security Benefits Law, to promote changes to maternity leave rules, directly impacting companies and their Human Resources Departments. Key changes in legislation:
Extension of maternity leave | It may be extended in cases of hospitalization of the mother or baby, provided the hospital stay exceeds two weeks. In such cases, the 120-day leave period will begin upon hospital discharge, and maternity pay will also be extended. |
Rest before and after childbirth | Allows the worker’s rest period to be extended by up to two weeks, upon presentation of a medical certificate. |
Self-employed and informal workers | The changes also apply to informal or self-employed workers who contribute to Social Security. |
