Maternity leave period extended in case of hospitalization

Law No. 15,222/2025, enacted by the Federal Government on September 29, amended the Consolidation of Labor Laws (CLT) and Law No. 8,213/1991, also known as the Social Security Benefits Law, to promote changes to maternity leave rules, directly impacting companies and their Human Resources Departments. Key changes in legislation:

Extension of maternity leave	It may be extended in cases of hospitalization of the mother or baby, provided the hospital stay exceeds two weeks. In such cases, the 120-day leave period will begin upon hospital discharge, and maternity pay will also be extended.
Rest before and after childbirth	Allows the worker’s rest period to be extended by up to two weeks, upon presentation of a medical certificate.
Self-employed and informal workers	The changes also apply to informal or self-employed workers who contribute to Social Security.

It is essential that employers pay attention to changes in deadlines and calculations related to maternity pay, considering the extension of leave and hospitalization period.
