Psychosocial risks: Companies may be fined starting in May
NR-1: Companies need to prepare for the new requirement
Starting May 26, 2026, companies will be required to include psychosocial risk factors in Occupational Risk Management (GRO), as established by the update to Regulatory Standard No. 1 (NR-1). This change has implications for occupational safety and health management, with a focus on promoting the psychological well-being of employees.
What are psychosocial risk factors?
Psychosocial risk factors in the workplace involve conditions that affect workers' mental, social, and physical health. Situations such as unattainable goals, work overload, bullying, lack of leadership support, and repetitive or isolated tasks can cause stress, anxiety, and other mental health-related illnesses. Starting in 2026, these issues must be formally recognized and addressed as an integral part of companies' occupational risk management processes.
Adaptation period
The transition to include psychosocial factors in the GRO began in an educational manner in 2025, with an adaptation period until May 2026. During this time, companies must prepare to adjust their processes by identifying, assessing, and controlling psychosocial risks in their work environments. Starting on May 26, 2026, the Labor Inspection will begin to fine companies that do not comply with the standard.
Preparation of companies
Until the date of entry into force, companies must implement the new requirements to avoid penalties. This involves creating a detailed plan for identifying and assessing psychosocial risks, as well as adopting preventive and corrective measures to minimize these factors. As of May 26, 2026, companies that have not completed these steps may be penalized by labor inspectors.
